The terms applicable to your transaction depend on the service or product you purchase and on the identity of the person or business supplying it.

Nothing in these Terms & Conditions excludes or restricts your statutory rights under applicable UK consumer law.

PART ONE

Terms & Conditions for Dog Training Services

1. Scope of These Terms

These terms apply to dog training and behavioural services booked directly with Lorenzo Barichella trading as Training Dog®.

They may also be adopted by independent trainers associated with the Training Dog® brand, provided that the relevant trainer makes this clear to the customer before the booking is confirmed.

Services may include:

  • Puppy training and socialisation.
  • Individual dog training sessions.
  • Recall and lead walking training.
  • Behavioural consultations.
  • Dog walking sessions undertaken for training purposes.
  • Training programmes involving the collection and return of a dog.
  • Online behavioural or training consultations.

Any specific arrangements agreed in writing for a particular service will also form part of the contract.

2. Independent Trainers and Contractual Responsibility

Training Dog® operates with independent dog trainers who may provide services under or in association with the Training Dog® brand.

Independent trainers are self-employed professionals and are not automatically employees of Lorenzo Barichella.

Where an independent trainer accepts a booking, provides the service and invoices the customer directly, the contract for that service will ordinarily be between the customer and the independent trainer, provided this arrangement has been made clear before the contract is formed.

The relevant trainer is responsible for providing the agreed services with reasonable care and skill and for complying with applicable legal obligations.

Training Dog® may facilitate enquiries, introductions, advertising and referrals without necessarily becoming a party to the resulting training contract.

However, nothing in these terms excludes any responsibility that Lorenzo Barichella or Training Dog® may have under applicable law or an agreement entered into directly.

Customers should be informed of the identity of their service provider before confirming a booking.

3. Booking a Training Session

A request for an appointment does not constitute a confirmed booking.

A booking becomes confirmed when the relevant trainer accepts it and communicates the agreed date, time, location and service arrangements.

Customers must provide accurate contact information and relevant details about their dog.

The trainer may request additional information to assess whether the proposed service is appropriate.

A booking may be declined where the requested service is outside the trainer’s expertise, availability or service area, or where reasonable safety or welfare concerns make the proposed arrangements unsuitable.

4. Prices and Payment

The price of a consultation, training session or programme will be communicated before the booking is confirmed.

Prices may vary according to the type of service, duration, location and trainer.

Any additional charges must be clearly explained and agreed before they become payable.

Payment arrangements, including invoicing and payment deadlines, will be communicated by the person or business supplying the service.

Where an independent trainer provides and invoices the service directly, payment is made to that trainer in accordance with the agreed terms.

Changes to published prices will not retrospectively affect confirmed bookings unless otherwise lawfully agreed.

5. Information About Your Dog

Customers must provide accurate information about their dog’s behaviour, health and training history where relevant to the requested service.

In particular, customers must disclose any known history of:

  • Biting or attempted biting.
  • Aggression towards people or other animals.
  • Significant fear, anxiety or reactivity.
  • Escape behaviour or unreliable recall.
  • Medical conditions that may affect training.
  • Other circumstances that may create a foreseeable safety or welfare risk.

Customers must inform the trainer promptly if any relevant information changes.

Failure to disclose important information may affect the trainer’s ability to provide the service safely.

6. Dog Welfare and Veterinary Care

The welfare of the dog is a priority during training.

Training methods and exercises will be selected with reasonable consideration for the dog’s age, health, temperament, previous experiences and individual needs.

Customers remain responsible for arranging appropriate veterinary care.

Dog trainers do not provide veterinary diagnoses or medical treatment.

Where a behavioural concern may have a medical cause, or where specialist assessment is appropriate, the trainer may recommend consulting a veterinary surgeon or veterinary behaviourist.

The trainer may adapt or discontinue an exercise where reasonably necessary to protect the dog’s welfare.

7. Owner Participation and Training Progress

Dog training is a learning process involving both the dog and the owner.

Customers are encouraged to follow the guidance provided and practise agreed exercises consistently between sessions.

The effectiveness of training may depend on the dog’s individual characteristics, the owner’s participation, the home environment and other circumstances outside the trainer’s control.

No specific behavioural result or timeframe is guaranteed.

However, this does not affect the trainer’s legal obligation to provide services with reasonable care and skill.

8. Safety During Training Sessions

Dogs may behave unpredictably, even when they have no known history of aggression or other behavioural concerns.

The trainer will take reasonable precautions when conducting sessions.

Customers must follow reasonable safety instructions and ensure that any equipment they provide is suitable and in appropriate condition.

Where training takes place in the customer’s home, the customer should provide a reasonably safe environment.

The trainer may modify, postpone or stop an activity if continuing would create an unreasonable risk to people or animals.

Any financial consequences of a session being stopped or rearranged will be assessed fairly, taking account of the circumstances and applicable consumer rights.

9. Training Sessions Without the Owner Present

Some training services may involve the trainer working with the dog without the owner being present.

Where this is agreed, the customer must provide appropriate contact information and disclose relevant health, behavioural and safety information.

Collection and return arrangements must be agreed in advance.

The customer must ensure that an authorised person is available where necessary for the agreed handover arrangements.

The trainer will exercise reasonable care while the dog is in their charge.

Any changes to the agreed collection or return arrangements should be communicated as soon as reasonably possible.

10. Late Handover or Collection

Customers are expected to be available at the agreed time for the collection or return of their dog.

If a customer is unexpectedly delayed, they should contact the trainer as soon as possible.

A delay may affect subsequent appointments and may require additional arrangements.

Any additional charge for a delay must be reasonable, proportionate, clearly communicated and consistent with applicable consumer law.

The trainer will take reasonable steps to safeguard the dog’s welfare while resolving an unexpected delay.

11. Cancellations and Rescheduling

Customers should give as much notice as reasonably possible when cancelling or rescheduling an appointment.

The applicable notice periods and any cancellation charges are set out in the separate

Cancellation Policy

, which should be made available before a booking is confirmed.

Cancellation charges must be fair and proportionate and must not exceed what is permitted under applicable consumer law.

Where a booking is made at a distance or away from business premises, any applicable statutory cancellation rights will take precedence over conflicting contractual terms.

12. Weather and Other Unexpected Circumstances

Outdoor training may be affected by extreme weather or other circumstances that make a session unsafe or unsuitable.

The trainer may propose a change of location, an alternative activity or a rearranged appointment where reasonably necessary.

If the agreed service cannot be provided, the customer’s entitlement to a refund or other remedy will be determined by the circumstances and applicable law.

13. Online Consultations

Online consultations may be provided using video conferencing or other agreed communication platforms.

Customers are responsible for having suitable equipment, an internet connection and an appropriate environment.

The trainer will provide advice based on the information reasonably available during the consultation.

Certain behavioural concerns may require an in-person assessment or veterinary referral.

If a significant technical problem prevents the agreed consultation from being delivered, the parties will seek an appropriate solution, including rescheduling or a refund where required by law.

14. Photographs and Video Recordings

Photographs or video recordings may be useful for assessing a dog’s behaviour or monitoring training progress.

Where recordings are made for service delivery, they will be handled in accordance with applicable data protection law.

Identifiable customer images, recordings or testimonials will not be used for public promotional purposes without an appropriate lawful basis and any consent required.

Customers should not publicly distribute recordings that identify other individuals without an appropriate legal basis.

15. Liability and Consumer Rights

The service provider is responsible for delivering the agreed service with reasonable care and skill.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded.

Nothing in these terms removes the customer’s statutory rights or remedies.

Where an independent trainer is the contractual service provider, responsibility for the performance of that service will ordinarily rest with that trainer, subject to applicable law and the actual contractual arrangements.

16. Complaints

If you have a concern about a training service, please contact the trainer responsible for your booking in the first instance.

Where the service was supplied directly by Lorenzo Barichella trading as Training Dog®, complaints may be sent to:

[email protected]

Training Dog® may assist with communications concerning an independent trainer where appropriate, without automatically assuming responsibility for the trainer’s contractual obligations.

PART TWO

Terms & Conditions for Digital Products & Courses

1. Scope of These Terms

These terms apply to educational digital products sold directly by Lorenzo Barichella trading as Training Dog®.

Products may include:

  • Online dog training courses.
  • Video lessons and training programmes.
  • Digital manuals and educational guides.
  • Electronic books and downloadable resources.
  • Other digital educational materials.

Where a product is sold by an independent retailer or third-party seller, that seller’s applicable terms will generally govern the transaction.

2. Product Information

Each product will be described on its relevant sales page.

Before purchase, customers should be provided with clear information about the product’s main features, price, access arrangements, material technical requirements and any applicable restrictions.

The content of a course or educational resource may be updated to reflect improvements in presentation, training guidance or technical delivery.

Any changes affecting an existing purchase must comply with the terms agreed at purchase and applicable consumer law.

3. Orders and Payment

Digital products may be purchased through Training Dog® sales pages or third-party checkout platforms, including ThriveCart.

Customers must provide accurate information when placing an order.

The total price and any applicable charges will be displayed before payment is confirmed.

Payment may be processed by a third-party payment provider.

An order confirmation and information about accessing the purchased product will normally be sent electronically.

If a purchase cannot be fulfilled, the customer will be entitled to an appropriate remedy, including a refund where required.

4. Access to Digital Content

Access to digital content may be provided through an online learning platform, a secure website, a digital file or another method described before purchase.

Customers may need to create an account or use login credentials to access purchased content.

Customers are responsible for keeping their login credentials confidential and for taking reasonable precautions against unauthorised access.

Account access must not be shared, transferred, sold or used to provide unauthorised access to other people.

Where a product is intended for individual use, purchasing one licence does not authorise access by multiple unrelated users.

5. Lifetime Access

Where a product is expressly advertised with lifetime access, that promise forms part of the customer’s purchase agreement.

The meaning and any material limitations of lifetime access must be clearly explained before purchase.

Unless otherwise expressly stated, lifetime access does not mean that every third-party platform or technology used to deliver the content is guaranteed to operate indefinitely.

However, Training Dog® will not arbitrarily remove access contrary to the terms agreed at purchase.

If the delivery of purchased content changes or ceases, the customer’s contractual and statutory rights remain applicable.

6. Intellectual Property and Permitted Use

Training Dog® educational materials, including original videos, course scripts, text, illustrations, training guides, logos and associated branding, are protected by applicable intellectual property law.

Purchasing a digital product grants the customer a limited, non-exclusive, non-transferable licence to use the content for the purposes stated in the product description.

Unless expressly authorised, customers must not:

  • Resell or redistribute purchased content.
  • Share account access with unauthorised users.
  • Upload substantial portions of courses to public platforms.
  • Reproduce or distribute course videos or manuals commercially.
  • Represent Training Dog® educational materials as their own original work.
  • Use protected materials to create competing commercial products without permission.

Nothing in these terms prevents uses permitted by law.

7. Educational Purpose

Training Dog® digital products are intended to support education and responsible dog ownership.

They provide general training principles, techniques and guidance.

They do not constitute an individual behavioural assessment, veterinary diagnosis or guarantee of a particular outcome.

Customers should consider their dog’s individual circumstances and seek appropriate professional or veterinary advice where necessary.

Training exercises should be carried out with reasonable attention to the safety and welfare of the dog and others.

8. Digital Content Cancellation Rights

Under applicable UK consumer law, consumers who purchase digital content online may have a statutory 14-day right to cancel.

Where a customer wishes to receive digital content during that cancellation period, the statutory right to cancel may be lost once supply begins, but only where the applicable legal requirements are satisfied.

Where required, these include the customer’s express consent to immediate supply, acknowledgement of the resulting loss of the cancellation right and the required confirmation of that agreement.

Acceptance of these Terms & Conditions alone does not necessarily satisfy those requirements.

Where the legal conditions for losing the cancellation right have not been met, the customer’s statutory rights remain unaffected.

The separate

Cancellation Policy

provides further information.

9. Faulty or Misdescribed Digital Content

Digital content supplied directly by Training Dog® must meet applicable statutory standards, including requirements concerning satisfactory quality, fitness for purpose where applicable and conformity with its description.

If digital content is faulty, not as described or otherwise fails to meet applicable legal standards, customers may be entitled to repair, replacement, a price reduction or a refund, depending on the circumstances.

Nothing in these terms restricts those statutory remedies.

10. Technical Requirements and Availability

Customers should ensure that they have a compatible device, suitable internet access and any software reasonably required to use the product.

Material technical requirements or restrictions will be communicated before purchase.

We aim to maintain reliable access to our digital products, but temporary interruptions may occur because of maintenance, technical failures or third-party service disruptions.

We will take reasonable steps to resolve problems affecting access to purchased content.

Where a failure amounts to a breach of the customer’s legal rights, appropriate remedies will be provided.

11. Third-Party Learning and Payment Platforms

Training Dog® may use third-party providers to process payments, manage enrolments and deliver educational content.

These may include ThriveCart, associated learning platforms and video hosting or content delivery providers.

Use of those services may also be subject to their applicable technical or account requirements.

However, the use of a third-party platform does not remove Training Dog®’s legal responsibilities where Training Dog® is the seller of the product.

12. Books Sold Through External Retailers

Training Dog® books may be sold through external retailers, including Amazon.

Where the customer purchases a book directly from an external retailer, the sales contract will generally be with that retailer.

The retailer’s applicable payment, delivery, cancellation and returns procedures will normally govern that transaction.

Customers should refer to their order confirmation to identify the seller and the applicable purchase terms.

13. Changes to Courses and Educational Materials

We may correct errors, update information or improve the presentation of educational materials.

Changes will not be used to remove material features promised at purchase without an appropriate legal basis.

Where a substantial change affects a customer’s rights or access, we will comply with applicable contractual and consumer law obligations.

14. Unauthorised Use and Account Restrictions

We may investigate suspected unauthorised sharing, resale or misuse of digital products.

Where reasonably justified, we may take proportionate steps to protect our content and systems, including restricting access associated with a material breach of the licence terms.

Any such action will be subject to the customer’s contractual and statutory rights.

15. Complaints and Customer Support

For questions about digital purchases, access problems or complaints concerning products sold directly by Training Dog®, please contact:

[email protected]

Please include your order reference and a description of the issue where available.

We will review the matter and seek an appropriate resolution.

Changes to These Terms

We may update these Terms & Conditions to reflect changes in our services, products, business operations or legal requirements.

Changes will not retrospectively remove statutory rights or materially alter existing contracts without an appropriate legal basis.

Nothing in these terms deprives consumers of statutory protections or rights concerning the courts in which they may bring proceedings.
